Focusing on criminals distracts from the more fundamental question and consequence. If bitcoin could work for a criminal, it could work for anyone, and in order for bitcoin to be viable as a currency, it has to work for everyone, including criminals. However, this is not a promotion of criminal activity using bitcoin as a funding mechanism; it is merely a recognition of the properties that allow bitcoin to function in the first place.
